Service Terms and Conditions


These Terms and Conditions govern the provision of the "COD Service" offered by us, The Radio Network of New Zealand Limited (TRN), to you, via our website at www.cancellationsondemand.co.nz.

The "COD Service" is the Cancellation on Demand service whereby TRN notifies you (by email and/or SMS or text message) of the cancellation of any sporting fixture(s) for which you requested to receive cancellation notices in your registration (or any amendment thereto) to receive this service.

COD Service

We rely on information received from third parties in providing the COD Service to you. While we take reasonable steps to ensure that this information is accurate before using it, we do not warrant that the information will be complete, accurate or up-to-date.

As the COD Service relies on communications services and links outside of our control, we cannot guarantee that the COD Service will always be available and error free.

Registration

It is your responsibility to ensure that all information provided when registering to receive the COD Service is and remains correct, complete and up-to-date.

You may cancel the COD Service at any time by logging into the site www.cancellationsondemand.co.nz and deleting the subscription options (SMS and/or e-mail). We will cease providing you with the COD Service as soon as possible after your instructions.

You may amend or alter the sporting body(s) in respect of which you receive the COD Service and/or the mode of communication by which you receive the COD Service by amending registration details online or by e-mailing amantef@radionetwork.co.nz. We will endeavour to provide you with the amended or altered COD service as soon as possible after receiving your instructions.

Charges

Where you elect to receive the COD Service via SMS or text message, you will (unless we notify you otherwise) incur a charge (via your mobile phone operator) each time we send you an SMS or text message for the purpose of providing the COD Service. The amount of this charge is detailed at www.cancellationsondemand.co.nz, and we reserve the right to change the amount of this charge from time to time by publishing the revised charge at www.cancellationsondemand.co.nz.

Email alerts from the COD Service are free of charge.

Intellectual Property

All intellectual property in connection with the COD Service, including (without limitation) the text, graphics, data images, logos, trade marks, trade names and copyright works, is owned by TRN or used by TRN under licence from the copyright owner.

Content and data provided in connection with the COD Service may not (except as expressly provided in these Terms and Conditions) be published, resold, reformatted, copied, reproduced, incorporated into any other work or publication in any form, transmitted or stored without TRN's prior written permission.

All Liability Excluded

To the extent permitted by law:
  • all warranties, representations and guarantees (whether express, implied or statutory) in respect of the COD Service are excluded, including without limit, suitability, fitness for purpose, and accuracy or completeness of information provided as part of the COD Service; and
  • RN will not be liable for any damage, loss or expenses, or indirect losses or consequential damages of any kind, suffered or incurred by you in connection with the COD Service.
If the New Zealand Consumer Guarantees Act 1993 applies, you may have rights or remedies which are not excluded or limited by the above.

The exclusions and limits set out in these Terms and Conditions will also operate for the benefit of the TRN affiliates and related entities, partners, relevant suppliers, licensors and agents of TRN which TRN uses to provide the COD Service (Related Parties).

Indemnity

You agree to indemnify TRN and Related Parties in respect of any loss, damage, cost or expense (including reasonable enforcement costs, whether incurred on a solicitor and own client basis or otherwise) suffered or incurred by TRN as a result of any inaccurate or incomplete information provided by you to TRN or any breach by you of any of your obligations under these Terms and Conditions.

Third Parties

In providing you with the COD Service we do not assume any obligation or duty of care to any other person. Nothing in these Terms and Conditions is intended to create for, or confer on, any other person a benefit which is enforceable at the suit of that person.

Unsolicited Electronic Messages Act
For the purposes of the Unsolicited Electronic Messages Act 2007, you will ensure that the email address and/or mobile telephone number provided when registering for the COD Service relates to an email account and/or mobile telephone account which is held by or used by you.

You also consent to receive from TRN electronic messages which relate to the sporting club(s) and/or organisation(s) which you are a member of or otherwise affiliated or connected with according to you registration (or any amendment thereto) to receive the COD Service.

Governing Law

The COD Service and these Terms and Conditions are governed by the laws of New Zealand and all matters or disputes connected with the COD Service or these Terms and Conditions will be dealt with by the New Zealand courts.

Amendments

TRN may amend these Terms and Conditions from time to time. You should periodically revisit www.cancellationsondemand.co.nz to review the then current Terms and Conditions. By continuing to receive the COD Service after any such amendment, you are deemed to have agreed to the amended Terms and Conditions.
